You can, but to maintain the same driving dynamics and performance it is recommended to have same tyre size and same season (summer/winter/all season) on both axles.
Around 1.6 mm of tread across the central three-quarters of the tread, across the full circumference, is the minimum legal limit. Many drivers replace tyres before 3 mm in order to have better wet performance.
If you drive all year long and are looking for performance in winter weather and wet weather, all-season tyres that have the 3PMSF designation might be good to consider. If you have to deal with lots of snow or really bad weather, regularly having winter tyres might be the best option for you.
